These Terms govern your use of fernfawn.com and any purchases from FERNFAWN LLC. By placing an order, you agree to these Terms.

ABOUT US

FERNFAWN LLC is a Wyoming limited liability company based in Huntsville, Alabama, United States. We create custom royal and renaissance-style portraits from your photographs. Every portrait is hand-designed by a professional artist using digital design tools. We do not use AI or automated image generation.

PRODUCTS

We offer premium poster prints, framed poster prints, and high-resolution digital files.. All portraits are custom-made from the photograph you provide.

Poster prints are produced by our professional print fulfilment partner, which operates production facilities in over 30 countries including the US, UK, Canada, Australia, and across Europe. Orders are produced at the facility nearest to the delivery address.

Digital files are delivered electronically via email after proof approval.

Digital artwork and printed products are different purchase formats. The selected format is clearly shown on the product page and at checkout. Please confirm your selection before completing your purchase.

ORDERING PROCESS

1. You upload your photograph and select your portrait style, size, and format.
2. Our artist hand-designs your portrait and sends a digital proof within 1-2 business days.
3. You review the proof and may request revisions (2 complimentary rounds included).
4. You approve the proof.
5. Your portrait is produced and shipped (poster) or delivered via email (digital file).

A binding contract is formed when we send your order confirmation email.

YOUR PHOTOGRAPH

You retain full ownership of your photograph. You grant FERNFAWN a limited, non-exclusive, royalty-free licence to use your photograph solely to create and deliver your commissioned portrait. This licence ends when your photo is deleted from our systems (90 days after delivery confirmation, per our Privacy Policy).

You confirm that:
- You own the photograph or have the legal right to use it for this purpose
- You have obtained consent from any identifiable person in the photograph
- The photograph does not infringe any third party's intellectual property, privacy, or other rights

We are not responsible for claims arising from photographs that infringe third-party rights.

RESTRICTED CONTENT

We do not accept orders using copyrighted characters, trademarked logos, or protected third-party elements without proper authorization. We reserve the right to decline any order that we believe may infringe third-party rights.

OUR INTELLECTUAL PROPERTY

Upon full payment, you receive a personal, non-commercial licence to display, print, and enjoy your portrait for private use. You may not resell, sublicence, commercially distribute, or claim authorship of the portrait design.

All website content, graphics, logos, and brand elements are the property of FERNFAWN LLC.

PROOF APPROVAL

When you approve your proof, you confirm satisfaction with the design and authorise production. Once approved, your order cannot be cancelled, modified, or refunded except in cases of damage or defect.

If we do not receive a response within 48 hours of sending your proof, we send a reminder. If no response is received within 48 hours of the reminder, we may consider the proof approved and proceed to production, or cancel the order at our discretion.

CUSTOM PRODUCT TERMS

For UK customers: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, Regulation 28(1)(b), the 14-day right of cancellation does not apply to goods made to the consumer's specifications or clearly personalised. This does not affect your statutory rights under the Consumer Rights Act 2015 for goods that are faulty, damaged, or not as described.

For EU customers: Under EU Directive 2011/83/EU, Article 16(c), the right of withdrawal does not apply to personalised goods. This does not affect your rights under the EU Sale of Goods Directive for non-conforming goods, including the minimum two-year legal guarantee.

For Australian customers: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits or excludes those guarantees.

COLOUR AND PRINT VARIATION

Colour differences between your screen and the printed poster are normal. Monitor calibration, ambient lighting, paper type, and printing processes all affect final appearance. These variations are industry-standard and do not constitute a defect.

PRODUCTION TIMELINES

We aim to deliver proofs within 1-2 business days and to ship posters within 5-12 business days of approval, depending on location. These are estimates, not guarantees. We will communicate significant delays promptly.

PRICING AND PAYMENT

Prices are in US dollars (USD). Standard shipping to the US, UK, Canada, Australia, and selected European destinations is included. Payment is processed securely by Stripe. We reserve the right to change prices at any time; changes do not affect confirmed orders.

PROMOTIONS AND DISCOUNTS

Any promotional offers, discount codes, or special pricing are subject to the conditions stated with the promotion. Promotions may be withdrawn or modified at any time. Unless otherwise stated, promotions cannot be combined.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, FERNFAWN LLC's total liability for any claim is limited to the amount paid for the relevant order.

We are not liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms excludes liability for death or personal injury from negligence, fraud, or any liability that cannot be excluded under applicable law.

GOVERNING LAW

US and Canadian customers: Laws of the State of Wyoming, United States.
UK customers: Laws of England and Wales, with the benefit of mandatory UK consumer protection provisions.
EU customers: Laws of your country of residence, with the benefit of mandatory EU consumer protection provisions including the Consumer Rights Directive 2011/83/EU.
Australian customers: Laws of Australia, including the Australian Consumer Law.

DISPUTE RESOLUTION

We encourage you to contact support@fernfawn.com to resolve disputes informally. Most concerns can be resolved through direct communication.

CHANGES

We may update these Terms. The date at the top reflects the most recent version.
