TERMS OF SERVICE

These Terms apply to fernfawn.com and to any order you place with
FERNFAWN LLC. By ordering, you agree to them.
WHO WE ARE
FERNFAWN LLC, a Wyoming limited liability company.

WHAT WE MAKE
We create custom, modern pet portraits from a photograph you supply.
Every portrait is illustrated by hand by a human artist. We do not use
AI image generators to create your portrait.
We offer three formats, clearly labelled on each product page:
• Unframed fine art print
• Framed print
• High-resolution digital file (no physical item)
Please check the format you have selected before completing checkout.
Australian orders are printed and framed in Australia. Orders placed
from other countries are produced at our print partner's facility
nearest the delivery address.
HOW ORDERING WORKS
1. You upload your photograph and choose your options.
2. Our artist illustrates your portrait and emails you a digital proof,
usually within 1–2 business days.
3. You review it. Revisions are unlimited and free — ask for as many
rounds as you need.
4. Nothing is printed until you approve your proof.
5. We produce and ship your portrait, or email your digital file.
A contract is formed when we send your order confirmation email.
If we don't hear back from you, we do not print. Your order simply waits,
and we'll send reminders. You can approve, request changes, or cancel for
a full refund at any time before you approve.
YOUR PHOTOGRAPH
You keep full ownership of your photograph.
You grant us a limited, non-exclusive, royalty-free licence to use it
solely to create and deliver your portrait. This licence ends when we
delete your photo (90 days after delivery — see our Privacy Policy),
unless you separately give us written consent to use your portrait in
our marketing.
By ordering you confirm that you own the photograph or have the right to
use it, that anyone identifiable in it has consented, and that it does
not infringe anyone's rights. We are not responsible for claims arising
from photographs supplied to us.
We may decline any order involving copyrighted characters, trademarks, or
other protected material.
YOUR PORTRAIT
Once your order is paid, you have a personal, non-commercial licence to
display, print and enjoy your portrait. You may not resell it, sublicense
it, distribute it commercially, or claim authorship of the design.
Our website content, logos and brand elements remain our property.
PRICES AND PAYMENT
Prices are shown in the currency displayed on the product page and at
checkout. Australian prices are in Australian dollars and include GST.
Payment is processed securely by Stripe and Shopify Payments. We never
store your full card details.
We may change prices at any time; changes never affect an order already
confirmed.
Promotions are subject to the conditions published with them, cannot be
combined unless stated, and may be withdrawn at any time.
DELIVERY
Delivery timeframes, costs and destinations are set out in our Shipping
Policy, which forms part of these Terms. All timeframes begin when you
approve your proof, and are careful estimates rather than guarantees.
We will tell you promptly if there is a significant delay.
CANCELLATIONS, REFUNDS AND RETURNS
Our Refund & Return Policy forms part of these Terms. In summary:
• Full refund, any time before you approve your proof.
• After approval, your portrait is made to order, so we can't refund
or accept returns for change of mind.
• If it arrives damaged, faulty, or materially different from the proof
you approved, contact us within 30 days and we'll replace or refund it.
Nothing above limits your rights under consumer law.
COLOUR VARIATION
Screens and paper render colour differently. Small variations between
your on-screen proof and the printed piece are normal in fine art
printing. If the print is materially different from the artwork you
approved, our Refund & Return Policy applies.
CONSUMER RIGHTS
Australia: Our goods come with guarantees that cannot be excluded under
the Australian Consumer Law. You are entitled to a replacement or refund
for a major failure and compensation for any other reasonably foreseeable
loss or damage. Nothing in these Terms limits or excludes those guarantees.
United Kingdom: Under Regulation 28(1)(b) of the Consumer Contracts
Regulations 2013, the 14-day cancellation right does not apply to goods
made to your specifications or clearly personalised. Your rights under the
Consumer Rights Act 2015 for faulty, damaged or misdescribed goods are
unaffected.
European Union: Under Article 16(c) of Directive 2011/83/EU, the right of
withdrawal does not apply to personalised goods. Your rights for
non-conforming goods, including the two-year legal guarantee, are
unaffected.
LIABILITY
To the maximum extent permitted by law, our total liability for any claim
relating to an order is limited to the amount you paid for that order, and
we are not liable for indirect or consequential loss.
Nothing in these Terms excludes liability for fraud, for death or personal
injury caused by negligence, or any other liability that cannot lawfully
be excluded — including guarantees under the Australian Consumer Law.
GOVERNING LAW
Australia: the laws of Australia, including the Australian Consumer Law.
United Kingdom: the laws of England and Wales.
European Union: the laws of your country of residence.
United States and Canada: the laws of the State of Wyoming.
In each case you keep the benefit of the mandatory consumer protections
of your home country.
RESOLVING PROBLEMS
Please email support@fernfawn.com first — we reply within 1 business day
and resolve almost everything directly.
CHANGES
We may update these Terms. The date above shows the current version.
Changes do not affect orders already confirmed.
